Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Personalist mobile app, website, and related services (together, the “Service”), operated by Personalist (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. You are responsible for the information you provide when registering, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. The Service

Personalist lets you photograph and catalog the clothes you own and uses artificial intelligence to generate outfit recommendations, virtual try-on images and videos, styling tips, trip packing plans, and style-persona insights, and to provide weather-aware suggestions. Features and limits vary by plan and may change over time.

3. Your Content

“Your Content” means the photos, text, and other materials you upload or create through the Service, including wardrobe photos and messages to the AI stylist. You retain ownership of Your Content.

You grant us a limited, non-exclusive, worldwide license to host, store, process, and display Your Content solely to operate and provide the Service to you - for example, to analyze your wardrobe and generate outfits and try-on visuals. This license ends when you delete the relevant content or your account, except for copies retained as required by law or for backup and security purposes.

You represent that you have the rights to upload Your Content and that it does not:

  • infringe anyone’s intellectual property, privacy, or other rights;
  • contain unlawful, harmful, or sexually explicit material;
  • depict another person without their consent, or include images you are not authorized to use.

4. AI-Generated Content

Outfit recommendations, try-on images, videos, styling tips, and other AI outputs are generated automatically and provided for informational and inspirational purposes only. They may be inaccurate, incomplete, or not reflect real-world fit or appearance. You are responsible for your own styling and purchasing decisions. Try-on visuals are simulated and do not represent a guarantee of how a garment will look on you.

5. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • reverse engineer, decompile, scrape, or attempt to extract the source code or underlying models of the Service, except where permitted by law;
  • interfere with or disrupt the Service, circumvent plan limits, or use automated means to access it without authorization;
  • upload malware or content that violates the rights of others;
  • resell, sublicense, or commercially exploit the Service without our permission.

6. Subscriptions, Billing, and Free Plan

The Service offers a free plan and paid subscriptions (“Pro” and “Pro+”) available on monthly and annual terms. Paid plans unlock higher usage limits and additional features.

  • Payment. Subscriptions are sold and processed through the Apple App Store or Google Play and managed via RevenueCat. Payment is charged to your store account at confirmation of purchase.
  • Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your store account is charged for renewal within 24 hours of the end of the current period.
  • Managing and cancelling. You can manage or cancel your subscription through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds. Refunds are handled by Apple or Google according to their policies. Except where required by law, payments are non-refundable.
  • Price changes. We may change subscription prices; changes apply to future billing periods and we will provide notice as required by the applicable app store or law.

7. Intellectual Property

The Service, including its software, design, text, graphics, and logos (but excluding Your Content), is owned by Personalist or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

8. Third-Party Services

The Service relies on third-party providers (including Supabase, Anthropic, FASHN, Open-Meteo, RevenueCat, Apple, Google, and Expo) and may link to third-party content. We are not responsible for third-party services or content, and your use of them may be subject to their own terms and privacy policies.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your information.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Personalist and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, and sections that by their nature should survive (such as content licenses you have granted for retained backups, disclaimers, and limitations of liability) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of your country of residence, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located there, except where applicable consumer-protection law provides otherwise.
